The appeal to the Council of State was filed by the local Short-Term Accommodation Managers Association (STAMA Greece), jointly with a property owner in the city’s 3rd Municipal District. The case concerns the decision of the ministries of Finance, Development and Tourism, which extends for a second consecutive year the freeze on the issuance of new registration numbers for short-term rental properties in the historic center of Athens, covering areas such as Plaka, Koukaki, Thissio and Metaxourgeio. The measure states that properties that had not obtained a registration number by December 31, 2024, cannot operate in short-term rental for the entire period of 2025 through 2026. At the same time, the owners who had already registered can continue with their activity as normal. According to STAMA Greece president Vassilis Argyrakis, “the complete ban on new registrations creates a two-speed market and unjustifiably restricts the right of citizens to utilize their property.” He added that “market regulation is necessary, but must be based on proportionate and documented measures.” The applicants say “there is a violation of the principle of equality and equal treatment in competition, and that the suspension of new registrations concerns only short-term rentals in the 1st-3rd municipal districts, without corresponding restrictions for hotels in the same areas.” They also state that “the measure violates the principle of proportionality, as it chooses the strictest solution (generalized suspension of registrations) without sufficient documentation of necessity and without it emerging that there were no milder, targeted measures.” --- Original source: https://www.ekathimerini.com/economy/real-estate/1298502/%ce%bcanagers-of-short-stay-rentals-file-appeal-against-athens-cap/
